Photographic & Video Images Policy

Photographs are used in SEN Space for many different reasons. The different uses should be considered separately and potentially have different conditions for processing. For example:

 

  • Photographs used in identity management may be essential for SEN Space records but should be deleted once a child is no longer in that setting, as it is no longer needed for the purpose for which it was held.

 

  • Photographs used in promotion/marketing type material should seek specific informed consent, and only be used in line with the consent provided. '

 

We have in place procedures to delete photographic images of children once they have left the organisation. However, we will seek permission if we wish to retain their photographic image(s) beyond their time in SEN Space.

 

We seek the permission of children (if applicable) and their parents before photographic images are taken for:

 

  • Official SEN Space use

  • Any local publication

  • The organisaton’s prospectus

  • The organisation’s website

  • Printed publications

  • SEN Space room displays

  • Photographs and promotion videos for fundraising / social media

 

We will always notify parents when SEN Space has given permission for an official press photographer to take photographs during an event which will then appear in the local press or in some other publication.

 

We believe there is no law preventing parents from taking photographs of their children at SEN Space events, as photographs taken purely for personal use are exempt from the Data Protection Act 1998. We do ask though that parents do not take photographs or videos on SEN Space’s premises due to the vulnerable nature of the children attending.

 

We believe this policy complies with current legislation. Staff will capture precious moments when their children are taking part in SEN Space events using the specified SEN Space iPad or iPhone.

 

We will ensure that photographs taken in SEN Space will only be taken by using the designated devices. Under no circumstance will a SEN Space personnel use their mobile phone to photograph children or to send the image to parents.

 

We believe we have a duty to prevent the unauthorised taking and publication of images of SEN Space children and staff.

 

We at SEN Space have a commitment to promote equality. Therefore, an equality impact assessment has been undertaken and we believe this policy is in line with the Equality Act 2010.

 

We all have a responsibility to ensure equality permeates into all aspects of SEN Space and that everyone is treated equally irrespective of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, and sexual orientation. We want everyone connected with this school to feel safe, secure, valued and of equal worth.

 

We believe it is essential that this policy clearly identifies and outlines the roles and responsibilities of all those involved in the procedures and arrangements that is connected with this policy.

 

 

Aims:

 

  • To have in place a safeguarding and child protection policy and related policies that outline clear procedures to ensure that we meet our responsibilities for safeguarding and promoting the welfare of all children.

  • To provide a clear approach to the taking of photographic and video images of children during their sessions at SEN Space.

  • To have in place health and safety control measures.

  • To ensure compliance with all relevant legislation connected to this policy.

  • To work with other organisations and the local authority to share good practice to improve this policy.

 

 

The management will:

 

  • work in conjunction with other management staff and the CEO to ensure all staff, children (if applicable) and parents are aware of and comply with this policy.

  • ensure risk assessments are:

 

  • In place and cover all aspects of this policy.

  • Accurate and suitable.

  • Reviewed annually.

  • Easily available for all SEN Space staff.

 

  • have in place the following health and safety control measures:

 

  • SEN Space policy published on website and in organisation and staff handbooks.

  • Parents/visitors reminded of policy at the beginning of all SEN Space events.

  • Parents sign consent forms to allow their children to appear in SEN Space publications or on the website or any other forms of social media.

  • SEN Space decides the conditions that apply to the taking of photographs during the sessions or events to safeguard children so that the event, learning, and experience is not disrupted.

  • The rights of all children are protected.

  • Parents informed when permission has been given for an official press photographer to take photographs at SEN Space events.

  • Parents are prevented from taking photographic images of SEN Space staff on their mobile phones or without consent.

  • All unauthorised images are destroyed.

  • Children are prevented from using their mobile phones during the sessions at SEN Space. The manager will keep all phones securely in the office / staff room and return to the child/ parent at the end of the session.

  • The rights of staff and children are always protected.

  • Permission obtained from staff to use their photographic images on the SEN Space website, social media, and publications.

  • Photographs taken for official use are stored electronically with other personal data and in line with current data protection guidelines.

  • Monitoring and reviewing procedures in place to ensure safe procedures continue.

 

 

SEN Space staff will:

 

  • Not photograph children using their mobile phone.

  • Comply with all aspects of this policy.

  • Inform the Manager if photographic images have been taken of them without their consent.

  • Under no circumstance use their mobile phone to photograph children or to send the image to parents.

  • Be aware of all other linked policies.

  • Maintain high standards of ethics and behaviour within and outside SEN Space and not undermine our ethos and values.

  • Work in partnership with parents and carers keeping them up to date with their child's progress and behaviour at SEN Space.

 

 

Parents/carers will:

 

  • Be aware of and comply with this policy.

  • Be asked to complete the consent form so that images of their children may be used:

 

  • In the SEN Space prospectus.

  • On the SEN Space website and other social media channels.

  • In the media.

  • On SEN Space displays in the setting.

  • Appear in any printed publication.

  • Appear on a professional video or photographs that may later be sold to raise money for the organisation.
